Modernising the Insolvency Laws - New
Corporate Rehabilitation Mechanisms
While the liquidation process remains an
integral part of the corporate insolvency law,
new corporate rehabilitation mechanisms were
introduced by the New Companies Bill in the
form of corporate voluntary arrangement and
judicial management to help rehabilitate ailing
companies that have the potential to be revived.
To resuscitate and rehabilitate a financially
distressed company, how can we utilise the
new corporate rehabilitation mechanisms?
Will this reduce the cost of compliance,
increase efficiency and protect the interests
of stakeholders?
